ADDING CANNABIS TO A TRIAL LAWYER’S PRACTICE 101
Legal services in the cannabis industry predominantly revolve around traditional business/property services that are largely transactional in nature. However, as a criminal defense attorney by trade, I urge litigators to also consider adding cannabis to their practice. And I’m not talking about obvious add-ons such as business litigation or defending against criminal charges, either. Courtroom advocacy experience is and will continue to be critical to effectively representing businesses in disciplinary hearings related to licensure. Enforcement actions against landlords leasing to illegal growers are also increasingly common and necessitate effective representation. While these hearings are typically administrative in nature with relaxed rules of evidence, a seasoned trial attorney is well-suited to effectively challenge evidence presented and advocate on behalf of a cannabis client.
