ADVISING LOCAL GOVERNMENT 101
Most states utilize a dual licensing system in which an applicant must be granted both state and local approval in order to obtain a cannabis license. This system empowers local government to dictate what type of commercial cannabis activity, if any, will be allowed in their jurisdiction. As such, there’s an opportunity for cannabis attorneys to work with local legislators in (1) developing local cannabis regulations and (2) developing and overseeing application processes. Legal services in this area can be particularly critical in a state that has recently legalized cannabis or will in the very near future, as research and analysis of regulatory structures in other states can help avoid headaches down the road.
