Any cannabis attorney advising an operational cannabis business should ensure that a compliance binder is physically maintained on the premises of any operation. The easiest way to figure out what needs to be included in the binder is to take a look at the local and state regulations that govern a given license type, as well as associated disciplinary guidelines. Many jurisdictions are also willing to provide the checklists that are used by staff when performing onsite inspections, so be sure to find out if this is an options at both the local and state level. Finally, do not fall into the trap of thinking that complying solely state regulations is enough to ensure operational compliance—it’s common for local regulations to have their own wrinkles.
