Building a brand in the hemp and cannabis industries is imperative since both industries have become increasingly saturated. The first step in building a brand is picking a business name. Cannabis and hemp operators shouldn’t choose a business name without first doing due diligence into the following:
- Search whether or not the intended business name is currently trademarked by searching the USPTO’s trademark database, as well as any state or international trademark search engine, if applicable. Pay close attention to the specific class the trademark is registered under in evaluating the viability of the name.
- If your cannabis or hemp client’s desired name isn’t already trademarked, check to see if a relevant website domain and social media usernames are available. If they are available, claim them immediately and make sure your client doesn’t publicize their chosen name until everything is locked up.
- File for intellectual property protection in all relevant jurisdictions, and regularly monitor the internet for infringers.
