THE PRACTICAL REALITY OF FEDERAL CANNABIS LEGALIZATION
Federal legalization tends to be lauded in the media as a cure-all for all the confusion we’re seeing from state-to-state when the opposite may be true. In all likelihood, a “State’s Rights” approach similar to what was proposed in the STATES Act will be utilized. The Federal Government will have a say in interstate commerce and foreign import/export, but it’s highly unlikely they will step in and create a comprehensive program. This practical reality brings up two important considerations for attorneys:
1. Building long-term client relationships will likely require providing legal services in more than one jurisdiction. Much like any other industry, production will inevitably become commoditized and clients will likely seek to do business with vendors in other jurisdictions.
2. Bite the bullet and consider taking the Unform Bar Exam. The UBE offers admittance into many states where cannabis has been “legalized,” and will make you a more marketable cannabis attorney in light of #1 above.
